FAQs about Huay Yai, Land in Thailand, The Buying process

Land prices
in Huay Yai vary considerably depending on location, road access, title,
utilities, views and development potential. Smaller residential plots can
command a higher price per rai, while larger development parcels can offer
considerably lower prices per rai. We recommend comparing current listings
rather than relying on an average price.

A rai is the standard Thai land measurement: 1 rai = 1,600 square meters = approximately 0.395 acres, or roughly 4 rai to one acre. Land is often further broken down into ngan (400 sqm, 1/4 of a rai) and wah (4 sqm) although this is often written as just rai and wah 

Listings are typically show size in rai, ngan, square wah and also square metres (m2).  It is written thus:  1-0-00.  There are 4 ngan in one rai or 1hectare (ha) = 6 rai 250 square wah

Broadly:
(1) view properties and agree terms,
(2) sign a reservation agreement and pay a reservation deposit to take the property off the market,
(3) your lawyer conducts due diligence,
(4) sign the Sale & Purchase Agreement and pay the balance of the deposit,
(5) complete the transfer at the Land Office, where remaining funds and transfer taxes are settled and title (or lease) is registered in your name. Time lines vary, but a straightforward cash purchase typically completes within 30–60 days of the initial agreement but can be considerably less

Thai banks generally do not offer mortgages to foreigners, although some may under strict conditions, often at higher rates.     

Mortgage requirements would include 2 years work  history with confirmed salary bank payments and tax payments, married, the land in the Thai spouses  name, substantial deposit and confirmation the foreigner has no call on the land.  

Huay Yai is very different from Pattaya.  It is a district on the outskirts of Bang Lamung, roughly 20 minutes from central Pattaya and Jomtien Beach. It offers larger land plots, quieter surroundings, golf courses, lakes, and mountain views at prices generally lower per rai than beachfront or city-center Pattaya, while still being a short drive from the beach, international hospitals, and Pattaya’s amenities — which is why it’s popular with buyers wanting space and privacy without leaving the wider Pattaya area entirely.   Its big difference, is Huay Yai has an established community whereas Pattaya is has a very transient population.  It is changing rapidly with many developments built and under construction.

Huay Yai is generally regarded as a quiet, low-density residential area compared to central Pattaya’s tourist strip, with many gated villa communities offering estate security, CCTV, and controlled access. As with anywhere, we’d recommend the usual precautions — secure fencing, an alarm system, and getting to know your neighbors — and we’re happy to point you toward specific developments known for strong security if that’s a priority.

Full ownership / confirmed titles (recommended):

  • Chanote (Nor Sor 4 Jor): The strongest Thai land title. Full freehold ownership with exact GPS-surveyed boundaries and physical boundary markers. Transfers are fast, usually 1–3 days.
  • Nor Sor 3 Gor: A confirmed title with boundaries mapped by aerial survey. Can be legally sold, leased, or mortgaged, and can often be upgraded to a Chanote.
  • Nor Sor 3: A basic certificate of use without precise GPS mapping. Transfers require a 30-day public notice period to rule out competing claims.

Lower-tier / restricted rights (not recommended for buying or investing):

  • Sor Kor 1: An old land possession notice with no precise mapping. Hard to sell or upgrade legally.
  • Nor Sor 2: Temporary permission to occupy land. Can’t be sold — only inherited.
  • Sor Por Gor 4-01: An agricultural land-reform document for farmers. Can’t be bought, sold, or mortgaged.

We only list properties on Chanote or Nor Sor 3 Gor titles, and we state the title type clearly on every listing.

How Foreigners Can Acquire Land or Villas in Thailand

Foreigners cannot own land in Thailand. Narrow exceptions do exist — such as investments of at least 40 million baht with BOI or Ministry of Interior approval, or certain inheritance cases — but this is uncommon.

The typical route for a villa is to lease the land while owning the house structure separately. A registered leasehold (prufruct) runs up to 30 years, is recordable at the Land Office, and may include a renewal option but renewals aren’t enforceable.

An alternative or complementary right is usufruct (สิทธิเก็บกิน, sidhi kep kin), which grants use and enjoyment of the land — including living on it or collecting income from it — for up to 30 years or the foreigners lifetime. It’s registered on the title deed and is non-transferable but can strengthen a foreigner’s position.  They can rent the property out but not sell it and it is not inheritable
